Terms of Service

These Terms of Service ("Terms") govern your use of the MailWorker Chrome extension and website (together, the "Service"). By installing the extension, creating an account, or using the site, you agree to these Terms.

1. What MailWorker is

MailWorker is a browser extension and related website that help you personalize and send email through the Gmail web interface using local automation. The Service is not a replacement for Gmail and is not affiliated with Google LLC.

2. Eligibility

You must be able to form a binding contract and comply with Google / Gmail policies and applicable law where you use the Service. You are responsible for activity that occurs through your browser session and any MailWorker account you control.

3. Accounts

Some website features may require sign-in (for example with a one-time email code). You agree to provide accurate information and to keep access to your email account secure. We may suspend accounts that appear abusive or fraudulent.

4. Free use, limits, and paid plans

We may offer free use subject to usage limits (for example a daily send allowance) and may offer paid "Pro" or similar plans with different limits or features. Prices, billing periods, and features will be shown at checkout or on the pricing page. Fees are generally non-refundable except where required by law or expressly stated otherwise.

5. Lawful outreach & email compliance

You must use the Service only for lawful email outreach. You are solely responsible for complying with all applicable email, privacy, marketing, and anti-spam laws and regulations in every jurisdiction where you or your recipients are located (including, where applicable, laws such as the U.S. CAN-SPAM Act, Canada's CASL, the EU/UK GDPR and ePrivacy rules, and similar local requirements).

Contact addresses you import or send to must belong to people who have subscribed to your communications, given valid consent for you to email them, or with whom you otherwise have a lawful basis to contact under applicable law. You must honor unsubscribe and opt-out requests promptly.

The Service is intended solely to support legitimate, permission-based outreach. You may not use it to send unlawful bulk mail, unsolicited spam, phishing, scams, or any other abusive or deceptive messages. We do not review your lists or content in advance, and we are not responsible for your compliance choices.

Because messages are sent through your own Gmail account, you also agree to comply with—and remain subject to—Google's Terms of Service, Gmail / Google Workspace Acceptable Use policies, sending limits, and any other applicable Google rules. Suspension, throttling, or other action taken by Google against your account is outside our control and remains your risk.

6. Acceptable use

Without limiting Section 5, you agree not to use the Service to:

• Violate applicable laws, including anti-spam and marketing laws
• Violate Google, Gmail, or Google Workspace terms, limits, or policies
• Send unlawful, deceptive, harassing, or harmful content
• Attempt to probe, disrupt, or reverse engineer the Service except as allowed by law
• Misrepresent your identity or affiliation in a fraudulent way

You are solely responsible for your recipient lists, message content, consent records, and compliance. High-volume or non-compliant outreach can lead to Gmail sending limits, blocks, or account action by Google — that risk is yours.

7. How sending works (important)

The extension operates inside your logged-in Gmail browser session. It does not store your Gmail password. Contact lists and message content used for sending are handled locally in your browser for the automation workflow and are not uploaded to us as part of that local send process. Emails are sent through Google's systems under your account.

8. Intellectual property

The Service, including branding, UI, and software, is owned by us or our licensors. You receive a limited, revocable, non-exclusive license to use the Service as provided. You may not copy, resell, or redistribute the extension except as allowed by the Chrome Web Store or applicable law.

9. Third-party services

The Service depends on third parties such as Google (Gmail), the Chrome browser / Chrome Web Store, and providers we use for hosting, email delivery, or payments. Their terms and outages are outside our control.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that sending will succeed for every recipient, that Gmail will accept all traffic, or that the Service will be uninterrupted or error-free.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MailWorker AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $50.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your email content and recipient lists, or your violation of these Terms or applicable law.

13. Suspension and termination

You may stop using the Service at any time by uninstalling the extension and/or discontinuing use of the website. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service.

14. Changes

We may update these Terms by posting a new version on this page. Material changes may also be communicated through the site or extension listing where practical. Continued use after changes take effect constitutes acceptance.
